A crash can change your week, your income and your health in seconds. The other driver's insurance company starts building its file right away. You deserve someone doing the same for you. Matthew J. Wilkins represents people hurt in car accidents across Fresno and the Central Valley, with personal attention from the first call.
Common causes
- Distracted driving, including phones and in-car screens
- Speeding and following too closely
- Running red lights and stop signs
- Drunk or drugged driving
- Unsafe lane changes and failure to yield
- Drowsy driving on long Valley commutes
What you may be able to recover
Every case is different, and no outcome is guaranteed. Compensation in an injury claim can include:
- Medical bills, past and future
- Lost wages and reduced ability to earn
- Pain, suffering and loss of enjoyment of life
- Property damage, where a vehicle or belongings were harmed
California law to know
- In most California injury cases the lawsuit deadline is two years from the date of injury (Code of Civil Procedure section 335.1). Some situations shorten or extend it, so do not wait.
- California uses pure comparative fault. If you are partly to blame, your recovery is reduced by your share but not eliminated.
- Since January 1, 2025, California's minimum liability limits are $30,000 per person, $60,000 per accident and $15,000 for property damage. Many at-fault drivers carry only the minimum, which is why your own uninsured and underinsured motorist coverage matters.
- If you were injured or the damage exceeded $1,000, a report to the DMV may be required within 10 days.
What to do now
- Get medical care, even if you feel fine. Some injuries show up days later.
- Call 911 and make sure a report is filed. Exchange information with the other driver.
- Photograph the scene, vehicles, injuries and any visible hazards.
- Do not give a recorded statement to the other insurer before you have talked to a lawyer.
- Keep every bill, receipt and record, and write down how the injury affects your day.
- Call us for a free consultation.
Frequently asked questions
How much does it cost to talk to you?
Consultations are free. The firm does not get paid unless and until you get paid. Ask about how case costs are handled when you call.
What if the other driver has no insurance?
You may be able to recover through your own uninsured motorist coverage. Note that California's Proposition 213 can limit certain damages for drivers who were themselves uninsured.
Should I accept the insurance company's first offer?
Early offers are often made before the full extent of your injuries is known. Talk to a lawyer before you sign a release, because a release usually ends the claim for good.
